By accessing pocconsults.com you agree to these terms. If you do not agree, please do not use the site. These terms apply to the website only; a signed consulting engagement is governed by its own agreement, which prevails over anything here in the event of conflict.
Informational purpose only
The regulatory summaries, frequently asked questions and guidance published on this website are provided for general information. They are not legal advice, and they are not a substitute for reading the applicable federal standard, your state requirements, or the specific manufacturer instructions for a device or product in your practice.
Federal standards, enforcement policy and penalty amounts change. We update this site periodically but cannot warrant that every page reflects the position on the day you read it. Where a page cites a regulation, verify the current text of that regulation before relying on it for a compliance decision.
No consultant-client relationship is created by reading this site or by submitting a form. That relationship begins only when we have both agreed the scope of an engagement.
Do not send protected health information
The forms on this website are not a secure channel for protected health information. Do not submit patient identifiers, clinical details or any other PHI through them. If we need to receive such information during an engagement we will arrange an appropriate secure method under a business associate agreement.
Intellectual property
All content on this website, including text, page structure, graphics, logos and the arrangement of material, is owned by Point Of Care Consults or its licensors and is protected by copyright and trade mark law.
You may view, download and print pages for your own internal reference within your practice. You may not republish, redistribute, sell, or use our content to create a derivative compliance product, and you may not remove any proprietary notice.
Manuals, policies and training materials supplied under a consulting engagement are licensed for use by the purchasing practice at the locations covered by that engagement. They may not be shared with, resold to, or reproduced for another practice or entity.
Acceptable use
You agree not to do any of the following.
- Attempt to gain unauthorised access to any part of the site, its server, or any connected system or network.
- Submit automated, repetitive or abusive form submissions, or attempt to circumvent rate limiting.
- Introduce malware, or interfere with the proper working of the site.
- Scrape, harvest or systematically extract content, including for the purpose of training a machine learning model.
- Impersonate another person or misrepresent your affiliation with any practice or organisation.
Third-party links and embeds
This site links to federal agency resources and embeds a map from Google Maps. We do not control those services and are not responsible for their content, availability or privacy practices. A link is not an endorsement.
Disclaimer of warranties
This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the site will be uninterrupted, error-free or that defects will be corrected.
Limitation of liability
To the fullest extent permitted by law, Point Of Care Consults and its officers, employees and consultants will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of or inability to use this website, or from reliance on information published on it.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
Indemnity
You agree to indemnify and hold harmless Point Of Care Consults from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these terms or your misuse of the website.
Governing law
These terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. The state and federal courts located in New Jersey have exclusive jurisdiction over any dispute arising from them.
